PARTICIPANTS TAKE PART AT THEIR OWN RISK. At Play In The Woods  (“Sam Harrison”) WILL NOT BE RESPONSIBLE FOR DEATH, PERSONAL INJURY OR LOSS OR DAMAGE OF PROPERTY OTHER THAN AS A RESULT OF NEGLIGENCE ON THE PART OF At Play In The Woods.

These Participation Terms and Conditions apply to the use of At Play In The Woods‘s activities (the “Activities”) including, but not limited to, the At Play In The Woods‘ sites, Brick Yard Woods, woodland and countryside.

Children need and want to take risks when they play. In the woods we aim to respond to these needs and wishes by offering children stimulating, challenging environments for exploring and developing their abilities. In doing this, we aim to manage the level of risk so that children are not exposed to unacceptable risks of death or serious injury.

All children however old they are, love to take risks. Their safety and welfare is a priority in the woods/forest. Rules are still needed in the woods as much as in a classroom, home or work place. .

We involve the children and other adults as much as we can in making rules up and setting the boundaries.

These Participation Terms and Conditions contain important information concerning participation by you and members of your party in the Activities provided by At Play In The Woods and, accordingly, you acknowledge and agree that you shall ensure that all members of your party are aware of and accept these Participation Terms and Conditions.

At Play In The Woods reserves the right to make changes to the Activities whether to conform to any applicable safety or other statutory requirements or otherwise.

The Activities comprise a challenging experience for most participants. Whilst reasonable care is taken by At Play In The Woods for the safety of participants, the Activities are inherently dangerous and there is a risk of injury or death. All participants will receive safety instruction prior to participation.

At Play In The Woods reserves the right to refuse admittance to the Activities or to remove a participant from the Activities should it be reasonable to do so, (including, without limitation, a participant who does not comply with the safety rules and advice, the safety systems in place or who is deemed to be under the influence of alcohol or drugs).

The Activities are physically demanding and require a degree of agility, strength and stamina. If participants have medical concerns they are advised to consult their doctor in advance. By agreeing to these Participation Terms and Conditions participants are certifying that they do not suffer from any medical condition which is likely to increase the risk of injury to themselves or others. Due to the physical nature of the Activities, At Play In The Woods recommends that pregnant women should not take part.

An authorised adult must stay in attendance at the At Play In The Woods site whilst children covered by their authorisation are participating in any of the Activities, unless agreed in writing otherwise (for example for Holiday Clubs, Saturday Morning Clubs, After School Clubs, Pre-School Sessions and Home Education sessions).

In order to participate in the Activities, all participants must be reasonably fit and healthy. It is the responsibility of the booking party to ensure that all members of their party meet these requirements.

Participants must inform At Play In The Woods in advance of attendance where there are material matters affecting attendees to site and their participation directly, indirectly and remedially in activities.  Material matters may include medical and health issues, dietary issues, religious issues and any other potential material issues.

Safeguarding children is our highest priority.  This means taking measures to ensure their safety and welfare.  This may include contacting the appropriate authorities for safeguarding concerns.

Where considered appropriate by At Play In The Woods staff, first aid will be administered to children.  Where staff consider it to be appropriate, emergency services will be contacted.

All participants must act responsibly and courteously at all times and must respect other participants. At Play In The Woods shall be entitled to prevent any person from undertaking or completing the Activities in the event it deems the behavior of any participant unsuitable.

Participants are not permitted to bring any tools, including but not limited to pen knives, bush craft knives and other knives, to At Play In The Woods’ Activities or Woodland’ sites/locations whatsoever.  If such tools are discovered they will be confiscated for the period of the Activities / session or the participant/participants will not be permitted to take part in the Activities / session at which point they will be asked to leave the site without refund of any payments.

Participants must be dressed appropriately and At Play In The Woods reserves the right to refuse admittance to the Activities to any participant who is not appropriately dressed.

No compensation will be payable by At Play In The Woods in the event that any participant is not permitted to, or decides not to, undertake or complete the Activities, for the reasons set out in this clause.

It shall be the responsibility of all participants to ensure that they are dressed appropriately and At Play In The Woods advises participants to wear clothing which they do not mind getting damaged. In particular the following restrictions shall apply:

(a) Participants may not undertake the Activities in sandals, flip-flops, plimsoles, slip-on shoes or high heels. Footwear must be securely fastened.  Participants are advised to wear sturdy footwear such as hiking boots, or trainers.

(b) At Play In The Woods may require that jewellery be removed.

(c) At Play In The Woods may require piercings to be removed or taped over.

(d) Participants are advised to wear long-sleeved shirts and long trousers. Participants are advised to wear multiple layers to provide warmth and flexibility regarding temperature, and gloves / hats for cooler weather.

At Play In The Woods will not be responsible for any damage to or loss of clothing or other personal items resulting from participation in the Activities (other than as a result of negligence on the part of At Play In The Woods).

At Play In The Woods will not be responsible for personal injury occurring as a result of participants wearing jewellery, piercings or inappropriate clothing (including footwear).

In the event it proves necessary to close the Activities for reasons beyond the control of At Play In The Woods and, in circumstances where you or your party have commenced participation in the Activities, you shall not be entitled to any compensation. In such circumstances, except as otherwise provided in these Participation Terms and Conditions any liability of At Play In The Woods shall be limited to the refund of any charges paid to At Play In The Woods.

At Play In The Woods may use photography during activities either as a medium for participants’ educational benefit or for At Play In The Woods’ business purposes such as marketing including for use on our web sites and for other marketing material including and not limited to magazine editorials, on-line editorials, advertisement flyers, magazine advertisements, on-line advertisements and other advertisements or public relations mediums.  Through participation you agree to allow At Play In The Woods to take photographs and video material for marketing purposes whether you are a parent representing your child, or a carer (including representatives of schools, pre-schools and other groups) representing a child within your care, or for your own purposes.  In circumstances where you would like to withdraw your consent for such photography for an individual child, group of children, other group or yourself you must expressly state this in writing to At Play In The Woods prior to the applicable event.

Nothing contained in these Participation Terms and Conditions is intended to nor shall limit the liability of At Play In The Woods in respect of death or personal injury caused by the negligence of At Play In The Woods or of its employees, agents or contractors.

If any of these terms (or any part(s) thereof) are determined to be illegal, invalid or otherwise unenforceable it shall be severed and deleted and the remaining terms shall survive, remain in full force and continue to be binding and enforceable.

Nothing above shall confer on any third party any benefit or the right to enforce any of these Participation Terms and Conditions.

These Participation Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales and you submit to the exclusive jurisdiction of the courts of England and Wales.

No variation to these Participation Terms and Conditions shall be binding unless agreed in writing by At Play In The Woods.
